1. What this privacy policy covers

We are committed to protecting and respecting your privacy and your data privacy rights.

This privacy policy describes how we collect, use and share your personal data, whether we are in the process of helping you find a job, helping you find workers, providing you with a service, receiving a service from you, or you are visiting our website.

It also describes your legal rights if you have concerns about how we collect and process your personal data.

We reserve the right to change this privacy policy from time to time. The latest version will always be accessible in the Jobhawk website and mobile apps.

2. Who is Jobhawk?

The data controller of your personal data is Scout4 Limited, an Isle of Man company which trades as Jobhawk and has its registered office at 11 Hope Street, Douglas, Isle of Man, IM1 1AQ.

3. Why Jobhawk collects personal data

Under the General Data Protection Regulation (Regulation (EU) 2016/679) (the "GDPR"), our bases for collecting Personal Data are as follows:

Legitimate Interests

Jobhawk is a marketplace for construction industry workers seeking employment ("Workers") and for companies seeking construction labour ("Employers").

If you are a Worker and have signed up for Jobhawk, applied for a job we’ve posted online or advertised, or otherwise contacted us, we feel it’s reasonable to expect that you are happy for us to collect and use personal information about you to help you find work, and to help Employers hire the best candidates for their jobs. We need to do these things so that we can function as a profit-making business, and to help you and other Workers get jobs.

If you are an Employer, we store your personal data and the personal data of individual contacts at your organisation. We think this is reasonable – we deem these uses of your data to be necessary for our legitimate interests as a provider of recruitment and other business services to you.

If you are a Supplier of services to our company, we use and store the personal data of individuals within your organisation in order to facilitate the receipt of services from you. We also hold your financial details, so that we can pay you for your services. We deem all such activities to be necessary within the range of our legitimate interests as a recipient of your services.

Consent

If you are a Worker, we may use your personal data to offer you additional products and services related to job search or your jobs. When we do, we are able to rely on soft opt-in consent as long as you do not opt-out of these communications.

Establishing, Exercising or Defending Legal Claims

Sometimes it may be necessary for us to process personal data in connection with exercising or defending legal claims. Article 9(2)(f) of the GDPR allows this where the processing "is necessary for the establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity".

This may arise for example where we need to take legal advice in relation to legal proceedings or are required by law to preserve or disclose certain information as part of the legal process.

4. What personal data we collect

We collect personal data that identifies you when you sign up for Jobhawk, and each time you use the service or contact us.

If you are a Worker:

When you apply for a job that we posted online or advertised, or otherwise contact us to discuss the Jobhawk service or job opportunities, we normally collect your contact details and may retain a copy of any discussion we have with you.

When you create an account in the Jobhawk app, you must provide us with your first and last name, and your verified mobile phone number. You then have the option of adding other information to your Jobhawk profile, such as:

You can always choose not to provide this personal information to Jobhawk, but it may mean that we are unable to provide you with the service or you have less success in finding jobs and getting hired.

When you use the Jobhawk app, we record a history of your usage such as the jobs you view, your job applications, your success in getting offers and jobs, and any ratings you give to or receive from employers.

If you submit your CSCS card or other cards or certificates to Jobhawk for verification, we may receive additional personal data from the company that provided your card or certification, such as details of the training you received, your qualifications or a personal photo.

When you use the Jobhawk app or visit our website, we also collect technical information, including your device type and operating system, the Internet protocol (IP) address used to connect your device to the Internet, your login information, browser type and version, time zone setting, and browser plug-in types and versions.

If you are an Employer:

When you create a user account on the Jobhawk website, we collect your name, employer name, email address and phone number.

When you use our website, services or mobile apps, we retain a history of your usage including your engagement with Workers. We also collect technical information, including your device type and operating system, the Internet protocol (IP) address used to connect your device to the Internet, your login information, browser type and version, time zone setting, and browser plug-in types and versions.

When you discuss our services or your jobs with our staff, we normally collect your contact details and may retain a copy of any discussion we have with you.

We may collect additional information about you on your company website, or on LinkedIn or other online services. If we connect to you on LinkedIn or other online services, we may retain a copy of any conversation we have with you.

When we contact you regarding our services or offers, or to request your feedback, we may collect any response from you to improve our services and marketing communications.

If you are a Supplier:

We’ll collect the details for our contacts within your organisation, such as names, telephone numbers and email addresses. We'll also collect bank details, so that we can pay you. We may also hold extra information that someone in your organisation has chosen to tell us.

If you are a visitor to our website:

When you visit our website, we retain a history of your visit and collect technical information, including your device type and operating system, the Internet protocol (IP) address used to connect your device to the Internet, your login information, browser type and version, time zone setting, and browser plug-in types and versions.

5. How we collect your personal data

If you are a Worker:

Our primary means to collect personal data from you is via the Jobhawk app. You can access and amend your profile any time, quickly and easily, in the lefthand menu of the app.

When we verify your CSCS card and similar certifications, we may receive personal data about your trade, training and qualifications from the companies that certified you.

When you engage with or are hired by Employers, we may receive their comments and ratings about your qualifications and/or performance.

When you apply for a job that we posted on Indeed or other job boards, we receive your contact details and whatever other information you shared with us.

Our staff may contact you via telephone, email or text message to request personal information from you related to your contact details, job preferences and availability for work.

You may contact our staff via telephone, email or text message to request support for our services or to discuss jobs and your job applications.

When you comment, like or follow our posts on Facebook and other social media, we may receive your personal data provided by those services.

We collect data automatically when you use the Jobhawk app or visit our website.

If you are an Employer:

Our primary means to collect personal data from you is via the Jobhawk website. You can access and amend your profile any time, quickly and easily.

We may have collected your contact details via our business development and marketing activities, your LinkedIn profile and/or your company website.

Our staff may contact you via telephone, email or text message to request information from you related to your contact details, recruitment needs and job posts.

You may contact our staff via telephone, email or text message to request support for our services or to discuss your jobs, applicants and hires.

We collect data automatically when you use the Jobhawk app or visit our website.

If you are a Supplier:

We collect personal data from you via email, telephone and your website.

If you are a visitor to our website:

When you visit our website there is certain information that we may automatically collect, whether or not you decide to use our services. This includes your IP address, the date and the times and frequency with which you access the website and the way you browse its content. We will also collect data from you when you contact us via the website, for example by using the chat function.

We may collect your data automatically via cookies, in line with cookie settings in your browser.

6. How we use your personal data

If you are a Worker:

Our main reason for using your personal data is to help you find jobs and get hired. The more information we have about you, your qualifications and experience, the better we can match you to Employers and jobs.

Here are some of the ways we may use and process your personal data for this purpose. Please note that this list is not exhaustive:

7. Who we share your personal data with

Jobhawk is provided and operated by Scout4 Limited, a company registered in the Isle of Man. The information you provide to us may be accessed by our staff working in the UK, the Isle of Man, or elsewhere in or outside the European Economic Area.

The information you provide to us will be transferred to and stored by third-party outsourced IT and document storage providers where we have an appropriate processing agreement (or similar protections) in place.

We also use other third parties to perform business support functions on our behalf, such as technical support, conducting market research, product development or analysing data. These third parties have access to your personal data to the extent necessary to perform their functions and are not permitted to use it for other purposes.

Scout4 Limited may disclose your personal data to their business partners or owners as part of any merger, acquisition, sale of company assets or similar transaction.

We may disclose your personal data to third parties if required to do so to comply with legal process or requirements, or to protect the rights, property or personal safety of others, including in the interests of fraud detection and prevention, or abuses of the Jobhawk service.

If you are a Worker:

When we verify your CSCS or other certifications, we share the minimum personal data required by the certification provider – for example, your card or certificate number, name and date of birth.

When you apply for a job in the Jobhawk app or we feel that you are a suitable candidate for a job, we share your personal data with the Employer.

If you are an Employer:

Your personal data is visible to any colleagues sharing your Jobhawk account.

When you post jobs, your personal data may be visible to Workers in the Jobhawk app, and we may also share it in on job boards, Facebook and other channels.

When you make job offers and hire Workers, we share your personal data only with the recipients of the offers.

8. How long we keep your personal data

If you are a Worker registered for Jobhawk:

We will keep your personal data until the later of:

When we refer to "meaningful contact", we mean, for example, communication between us (either verbal or written), or where you are actively engaging with our services. Your receipt, opening or reading of an email or other digital message from us will not count as meaningful contact – this will only occur in cases where you click-through or reply directly.

If you are an Employer registered for Jobhawk:

We will keep your personal data for 5 years after your company last logged in to our website or services.

If you are a visitor to our website:

We will Delete your personal data from our systems if we have not had any meaningful contact with you (or, where appropriate, the company you are working for or with) for two years.

9. How we safeguard your personal data

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of personal data, we have put in place physical, electronic, and managerial procedures to protect the information we collect. These include measures to deal with any suspected data breach.

If you have a password or security code which allows you to access our services, it is your responsibility to keep it confidential.

Unfortunately, the transmission of information via the Internet is not completely secure. We cannot guarantee the security of any information that you transmit to us, or receive from us; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Our website and mobile apps may contain links to third-party websites of Employers, as well as our partners, social networks, advertisers and affiliates. Clicking on those links may allow third parties to collect or share data about you. We do not control these 3rd party websites and are not responsible for their privacy practices or content.

10. International transfers of your data

Personal data which we collect is generally stored and kept inside the European Economic Area.

However, the information you provide to us may be accessed by our staff working in the Isle of Man, or elsewhere outside the European Economic Area. Such staff may be engaged in, among other things, the provision of support services to Workers and Employers. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Additionally, due to the nature of the technologies we require, your personal data may be transferred to third-party service providers outside the EEA, in countries where there may be a lower legal level of data protection. In such situations, we transfer the minimum amount of data necessary, anonymise it where possible and enter legal contracts to aim to ensure these third parties handle your personal data in accordance with this Privacy Policy and the European levels of data protection.

Although Jobhawk is currently serving only the UK construction market, the service is accessible via the Internet and may potentially be accessed by Workers, Employer personnel or other persons from outside the EEA. In these circumstances, a transfer of your data outside of the EEA may be deemed to have occurred.

11. Our use of Cookies

We may use "cookies" on our website and/or equivalent software on your phone to help us personalise your Jobhawk experience.

Cookies are small files that are placed on your computer through your web browser. Each time you access our website, cookies automatically collect certain information about you, including computer and connection information, browser type and version, operating system and platform details, the time of accessing the website and other information. We use cookie information in support of the activity you are carrying out, for anonymous user analysis, and for research and development.

Most browsers will let you turn off cookies. If you are not sure whether your browser has this capability, please check with the software manufacturer or your Internet service provider.

12. Your legal rights

We want to ensure your personal data is accurate and up to date. 

If you are a Worker, you can view and edit the personal data you have given us, in the lefthand menu of the Jobhawk app.

You also have various rights in respect of your data, even once you have given it to us. These are described in more detail below.

We will seek to deal with your request within one month (subject to any extensions to which we are lawfully entitled). Please note that we may keep a record of your communications to help us resolve any issues which you raise.

You have the right to:

Object to processing if we are using your personal data in some way because we deem it necessary for our legitimate interests to do so, and you do not agree.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to process it.

Make a Data Subject Access Request to receive a copy of the personal data we hold about you. We may require you to verify your identity and for more information about your request.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate personal data we hold about you corrected, although we may need to verify the accuracy of the new data you provide to us.  

Request erasure of your personal data, if we do not have a valid reason to continue to process it or we have processed it unlawfully. If we agree to your request, we will delete your data but keep a note of your name and contact details to record our response to your request and minimise the chances of you being contacted in the future where your data might be collected in unconnected circumstances.

Withdraw consent at any time where we are relying on your consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent.  

Data portability. If you wish, you have the right to transfer your data from us to another data controller. We will help with this - either by directly transferring your data for you, or by providing you with a copy in a commonly used machine-readable format.
